I think this is due to:

2013-11-28  Stefan Monnier  <monnier <at> iro.umontreal.ca>

   * vc/vc-dispatcher.el (vc-log-edit): Setup the Summary&Author headers.

log-edit with non-nil SETUP first erases the log buffer, thus defeating
the purpose of log-edit-empty-buffer-p.
